Avoid Crippling Effects of CASL on Your Business

Written on 06/26/2014

A new Canadian law going into effect on July 1, 2014, will substantially restrict electronic marketing for American companies that do business in Canada. The Canadian Anti-Spam Law [CASL] regulates many routine business activities that the clientele of AspenTech rely on to reach their customers. CASL has legal implications that will affect American companies with its extra-territorial reach. It has been described as the toughest anti-spam law in the world.

Implications of CASL on Businesses

Sending marketing emails, text messages, or social media messages to individuals in Canada that run afoul of CASL could mean astronomical fines. CASL also regulates software downloads, including programs and updates to mobile applications. Please note, that AspenTech is not qualified to offer legal advice, so each person is responsible for ascertaining their own CASL compliance requirements (please review http://fightspam.gc.ca/eic/site/030.nsf/eng/home to learn more).

However, time is running short. You have until June 30, 2014, to act before major fines are levied for non-compliant companies doing business in Canada. Fines may be assessed at a minimum of $1,000,000 and up to $10,000,000.
